Filling A Vacancy 101: Board of Education

What's next for the BOE now that a member has resigned?

Now that John Tavis has resigned, what does the Board of Education do now?

According to state law, the board will have 60 days from the date of the resignation to fill the vacancy, normally by a majority vote of the board. If the board fails to do so, the vacancy could be filled by the county superintendent, the law reads

The Wall Township Board of Education bylaws say that the board will publicly notice for the vacancy and solicit candidates willing to fill it.

The board will then interview candidates for the vacancy. This may or may not be done in public session. The vote to appoint a candidate, however, will be in public session, the bylaws read.

Whoever is appointed to the seat will serve until the board’s next organization meeting, which will be in January, 2014.

The appointed person may run for the remainder of Tavis’ term in the November election, along with any other qualified candidate interested in the remaining two years of the term.
