ReplyWhen the NFIP was originally started, FEMA did not exist. NFIP was under Housing and Urban Development. NFIP will never be solvent as long as FEMA is paying for uninsured claims. FEMA is killing NFIP. I've heard one statistic that when Katrina hit, 1 in 4 claims were insured; for Sandy, it was 1 in 10. Biggert Waters tries to cure the symptomatic problems at NFIP instead of addressing the root causes at FEMA. By opposing the delay in increasing NFIP premiums, Sen Toomey is supporting increasing the pool of funds FEMA will have available to squander. Unless he has a plan to safeguard those premiums, his actions are reckless.

Listen to the last hour of this video. FEMA is proud that the maps were released early and expect corrections after comment from local officials. FEMA has redefined its mission statement from disaster recovery to mitigation manager. Interpret to the "FEMA speak" and you will hear the FEMA official stating that FEMA is ineffectual because it is understaffed( translation we need to justify our existence because we are not sufficiently effective. Sandy is a "test" for the new policies.
Possible class action lawsuit: certain mortgages require NFIP coverage which is administered by FEMA. FEMA has stated that maps are erroneous. Requiring certain homeowners to abide by conclusions made in accordance with recognized false information constitutes fraud; antitrust actions; unreasonable seizure of personal property.
Keep pitching the possible causes of action until one sticks! -

Senator Coburn starts at the 1:11 mark and pushes hard at 1:18 when FEMA states that they have not heard concerns about the maps but have heard complaints about funding. Coburn counters with "We have all heard complaints about the maps." -

"A FEMA spokesman did not immediately return a call seeking comment on Christie’s assertion. But the head of FEMA, Craig Fugate, testified at a congressional hearing on March 20 in Washington that the maps may very well be changed over the next 16 months. When asked by U.S. Sen. Tom Coburn, an Oklahoma Republican, whether the zone designations will stay the same “for every household” when the maps are finalized, Fugate responded, “I cannot say that for every household.”"Some V zone properties will not have relief. They will be subject to the adopted elevation requirements. Those property owners do not need to apply to DEP for permits to rebuild because the new standards have been adopted.

ReplyThe standards for the building elevations are what has been adopted. The release stated that the zoning on the maps are what is expected to change. If the zoning on the maps change, the building requirements will follow the re-designation. If your in a V zone and the maps are changed to A, you're in luck. If you're currently in an A which is set to be changed to a V and it stays a V, you're SOL.

ReplyIs it correct that NJ Transit, NY MTA etc do not have flood insurance but have received billions of dollars in FEMA payments? The only information I found was MTA was insured for business interruption not flood. Will they be required to have coverage under NFIP if the new FEMA maps are adopted? Their participation as well as other nationwide public works that receive FEMA flood funds would greatly improve the finances of FEMA. If not, the validity of the BWA requirements seem to be highly disputable. Do not accept Washington dropping its problem on the doorsteps of homeowners.

ReplyBriggert Waters only reauthorizes NFIP until 2017. One can only imagine what new hurdles will be set up at that time, if NFIP is still around.

@proud, the more information the better! Your link gives a good explanation of how government avoided getting involved in the flood insurance market for almost half a century. My link gives some of the strides made under NFIP. Both point to the FEMA borrowing required to pay Katrina claims as a threatening blow to the viability of NFIP.
